The purpose of the Senior Attorney is to handle and maintain a case load of complex bankruptcy, foreclosure, title, and litigation matters on behalf of banks, investors, mortgage servicers and other creditors.
The ideal candidate would be an attorney with both a California and Texas law license and 8 years default servicing experience. The attorney can decide to work either remote, or in our Texas or California office.
KEY JOB DUTIES
- Collaborate with attorneys and support staff regarding procedures utilized in the firm’s bankruptcy/foreclosure practice, including steps in the process, documents, local filing requirements and judicial tendencies.
- Perform directly and/or provide direction around complex title resolution matters; includes title claims, quiet title actions and other resolution options.
- Provide loan level recommendations as well as ensuring the associated policies and procedures are in compliance with the Federal Bankruptcy Code, local rules, case law, etc.
- Review and analyze client documents, bankruptcy filings such as proofs of claim, notices of mortgage payment change, and notices of fees and costs loan documents, title searches, payment histories, pleadings, motions, affidavits, discovery, etc.
- Draft pleadings, motions, certifications, objections, orders, memoranda, and letters.
- Attend hearings, settlement conferences, and other appearances as required (live, video & telephonic).
- Keep clients apprised of case statuses and developments with appropriate communication via e-mail, telephone, and client systems.
- Promptly review and respond to communications received via phone, e-mail, client systems, opposing counsel, court staff, trustees, mediators, etc.
- Escalate matters when necessary and perform other duties as assigned.
Requirements
- Excellent oral and written communication skills with ability to communicate at all levels.
- Effective organizational, time management, problem-solving and analytical skills.
- Ability to organize and manage a caseload.
- Ability to manage priorities and workflow in a high-volume production environment.
- Ability to work and communicate with variety of legal, non-legal and client stakeholders.
- Must be a self-starter.
MINIMUM QUALIFICATIONS:
- Juris Doctorate from an ABA-accredited law school.
- Member in good standing with the California Bar Association; and Texas State Bar license in good standing is a plus.
- 8+ years’ experience representing secured creditors / mortgage services preferred; Bankruptcy or Default Mortgage Industry experience required.
- Working knowledge of BKFS LoanSphere Default, Sagent Tempo, etc.
- CaseAware experience preferred.
- Competency with Microsoft Office Suite including Outlook, Word, Excel, and PowerPoint.
- SharePoint experience is a plus.
